This Privacy Policy describes how Fans First Research, LLC (“we,” “us,” or “our”) collects, uses, discloses, and protects your personal information when you visit fansfirstresearch.com (the “Site”) or otherwise use our surveys and related services (the “Services”). If you do not agree with this Policy, please do not use the Services. Questions may be directed to info@fansfirstresearch.com.

SUMMARY OF KEY POINTS

  • We collect a limited amount of personal information — principally your email address, and, for mail-in sweepstakes entries, your name and mailing address.

  • We collect your survey responses, which reflect your opinions about events.

  • We do not sell your email address or other information that directly identifies you. We do sell and share survey data with event organizers and other parties in aggregated and/or de-identified form.

  • We use third-party platforms (SurveyMonkey and Mailchimp) to collect responses and send opt-in email.

  • We do not knowingly collect information from anyone under 18.

  • You have choices and rights regarding your information, described below.

  • Geographic scope: The Services are intended for and directed to residents of the United States. They are not intended for, or directed to, individuals located in the European Economic Area (EEA), the United Kingdom, or other jurisdictions outside the United States, and we do not knowingly collect or process personal information from such individuals. If you are located outside the United States, please do not use the Services or provide us with personal information. Any information you provide is processed and stored in the United States, where data-protection laws may differ from those of your location.

1. INFORMATION WE COLLECT

Personal information you provide. We collect personal information that you voluntarily provide when you take a survey, enter the sweepstakes, or contact us. This includes:

  • Email address — collected when you submit a survey response or enter the sweepstakes online;

  • Name and mailing address — collected only if you submit a free mail-in sweepstakes entry (see the Official Rules);

  • Survey responses — your answers, opinions, and feedback about events; and

  • Communications — any information you include when you email or otherwise contact us.

Information collected automatically. When you visit the Site, certain information may be collected automatically through cookies and similar technologies used by our website platform (Squarespace), such as basic device and usage information. Please see our Cookie Policy for details. We do not use third-party advertising, analytics, or tracking pixels on the Site.

We do not collect Social Security numbers, payment card numbers, government identifiers, precise geolocation, or special categories of sensitive personal information.

2. HOW WE USE YOUR INFORMATION

We use the information we collect to:

  • Administer and process surveys and compile, analyze, aggregate, and de-identify the responses;

  • Create and provide research, insights, and aggregated or de-identified data sets to event organizers and other interested parties;

  • Administer the sweepstakes, including selecting and notifying winners and delivering prizes;

  • Send you marketing or promotional emails, but only if you have opted in, and always with the ability to opt out;

  • Respond to your inquiries and provide support; and

  • Comply with legal obligations and enforce our terms.

3. HOW WE SELL OR SHARE INFORMATION

Survey data. Our business involves selling and sharing survey data with event organizers and other interested parties. We do this in aggregated and/or de-identified form so that the data we sell does not identify you personally.

Personal identifiers. We do not sell or rent your email address, name, or other information that directly identifies you. We may share such information with our service providers (below) for the limited purposes of operating the Services, and as required by law or to protect our rights.

Although we believe that the sale of aggregated and de-identified data generally does not constitute a “sale” or “sharing” of personal information under applicable U.S. state privacy laws, we describe these practices transparently and offer you the right to opt out as described in Section 8. 

4. SERVICE PROVIDERS

We use trusted third-party platforms to operate the Services. Your information is processed by these providers under their own privacy and security terms:

  • SurveyMonkey (Momentive) — used to host and collect survey responses;

  • Mailchimp (Intuit) — used to store email addresses and send opt-in email communications; and

  • Squarespace — used to host and operate the Site.

We encourage you to review the privacy policies of these providers. We do not authorize them to use your personal information for their own marketing.

5. EMAIL MARKETING AND YOUR CHOICES

We send marketing or promotional email only to users who opt in. Every marketing email includes an unsubscribe link, and you may opt out at any time, consistent with the CAN-SPAM Act. We do not send marketing text messages. Transactional messages necessary to administer a survey or the sweepstakes (such as a winner notification) are not marketing messages.

6. HOW LONG WE KEEP INFORMATION

We keep personal information only for as long as necessary for the purposes described in this Policy, unless a longer period is required or permitted by law. Specifically:

Email address — retained until you opt out or ask us to delete it, after which we remove it from our active marketing lists within a reasonable period.

Survey responses — kept in a form that identifies you only as long as needed to compile and deliver our research. After that, we retain them only in aggregated or de-identified form, which no longer identifies you, so the research value is preserved without keeping data that identifies you.

Sweepstakes records — retained only as long as necessary to administer the applicable promotion and to meet legal, tax, and recordkeeping obligations, and then deleted.

7. HOW WE PROTECT INFORMATION

We maintain reasonable administrative, technical, and organizational safeguards designed to protect your information, and we limit internal access to the principals who operate the business. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. YOUR PRIVACY RIGHTS

Depending on where you live, you may have the right to: (i) request access to or a copy of the personal information we hold about you; (ii) request correction of inaccurate information; (iii) request deletion of your information; (iv) opt out of the sale or sharing of your personal information; and (v) not be discriminated against for exercising your rights.

How to exercise your rights. You may exercise these rights by emailing us at info@fansfirstresearch.com. You may also opt out of email and manage your data directly through the unsubscribe and privacy controls offered by SurveyMonkey and Mailchimp. We will respond to verifiable requests within the time required by applicable law (generally within 45 days, with one permitted extension), and there is no charge for a reasonable request.

9. DO-NOT-TRACK AND GLOBAL PRIVACY CONTROL

Some browsers transmit “do-not-track” signals or an opt-out preference signal (such as Global Privacy Control). Because there is no common industry standard, we currently respond to such signals where required by applicable law and otherwise handle data as described in this Policy.

10. CHILDREN’S PRIVACY

The Services are intended only for users 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected such information, we will delete it. If you believe a minor has provided us information, please contact info@fansfirstresearch.com.

11. STATE-SPECIFIC NOTICES

Residents of California and certain other states have specific rights under state privacy laws, including the rights described in Section 8. California’s “Shine the Light” law permits residents to request information about disclosures of personal information to third parties for direct-marketing purposes; we do not share personal identifiers for third-party direct marketing. 12. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. The updated version will be indicated by a revised “Effective Date” and will be effective when posted. We encourage you to review this Policy periodically.
